Contracting Parties

Supplier: HOTEL PARTIZÁN, s. r. o. - provider of accommodation, catering, congress, sports, and wellness services (hereinafter referred to as "hotel") to the customer (guest) for a fee.
Operation: Mýto SKI & BIKE center

Provider of sports and catering services.

Customer: Service Ordering Party - a natural or legal person with whom the supplier concludes a contract (agreement) for the provision of services at Mýto SKI & BIKE center

These general terms and conditions of HOTEL PARTIZÁN, s. r. o. with registered office at Bystrá 108, 977 01 Bystrá, registered in the Commercial Register of the District Court Banská Bystrica, section Sro, insert number 6823/S, telephone number 048/6308813, e-mail: ski.myto@partizan.sk (hereinafter referred to as "operator") for the online store "Online ticket purchase" located at the website address www.kopeczabavy.sk (hereinafter referred to as "terms and conditions") are an integral part of purchase agreements concluded in accordance with these terms and conditions, for the purchase and sale of online tickets offered by the operator.

1. INTRODUCTORY PROVISIONS

These business conditions regulate the mutual rights and obligations of the contracting parties arising in connection with the conclusion of purchase agreements via the "Online ticket purchase" online store (hereinafter referred to as the "online store"), which is operated by the operator on the website www.kopeczabavy.sk (hereinafter referred to as the "website").
The customer can purchase online tickets through the online store via the operator's website, the purchase price of the online ticket is paid using the Global Payments payment gateway, s. r. o.
By purchasing a ticket online, the customer undertakes to respect and comply with these business conditions, as well as the valid and effective operation regulations of Mýto ski & bike area issued by the operator, the wording of which is available at the administration office of the Mýto ski & bike area and also on the website www.kopeczabavy.sk. The sale of online tickets is carried out in accordance with the provisions of applicable legal regulations, in particular Act No. 102/2014 Coll. on consumer protection when selling goods or providing services based on a distance contract or a contract concluded outside the premises of the seller in the valid wording, and Act No. 122/2013 Coll. on the protection of personal data in the valid wording.

Based on the purchase of an online ticket, the customer is entitled to use the services specified in the current price list for the respective season during the validity period of the ticket:
a) POMA UNIFIX chairlift,

b) access to attractions - MAXI TRAMPOLINE, JUMP HILL, CHILDREN'S BIKE TRACK, SKILL TRAIL, PUMP TRACK, SUMMER TUBING

2. BUY TICKETS ONLINE

2.1. All physical and legal persons, under the conditions set forth below, may purchase tickets online through the online store.

2.2. The following types of online tickets can be purchased through the online store:

1) All-day cable car ticket for bikers (BONUS! admission to attractions included)

2) Two-day cable car ticket for bikers (BONUS! admission to attractions included)

3) Three-day cable car ticket for bikers (BONUS! admission to attractions included)

4) Season pass

All types of tickets can be purchased in tariffs for Juniors and adults (individuals over 140 cm) and children (individuals under 140 cm).

2.3. Purchase of discounted tickets online is not possible. Discounted tickets can only be purchased in person at the resort ticket office during operating hours with the submission of the required documents.

2.4. The customer completes the purchase of tickets through the online store by filling out the mandatory fields in the online store form. This primarily involves: 1) selecting the type of ticket, 2) selecting the method of purchase, 3) entering contact information, 4) specifying the start date of ticket validity, 5) checking the agreement with these terms and conditions, the valid operating regulations of the operator, and the consent to the processing of personal data, and 6) providing a binding confirmation of the order. The binding confirmation of the order is considered the conclusion of the purchase contract. Subsequently, the customer is shown the total purchase price, which must be paid through the Global Payments payment gateway. The specified purchase price is the final price, including all fees. By concluding the purchase contract, the customer confirms that they have familiarized themselves with these terms and conditions and agree to them.

2.5. There are two forms of purchase available:

1) Without registration, where the customer does not create an account on the website www.kopeczabavy.sk.

2) With registration, where the customer creates an account on the website www.kopeczabavy.sk and has the opportunity to purchase tickets under preferential conditions.

2.6. The purchase of online tickets is not conditional on owning the ticket medium - AXESS company's chip card (hereinafter referred to as "chip card"). The chip card will be issued at a self-service machine by presenting the QR code to the reader.

2.8. Only one online ticket can be activated per chip card.

2.9. The use of the chip card and online ticket is governed by the current operating rules of the operator, which are available at the office of the Mýto ski & bike center and on the website www.kopeczabavy.sk.

2.10. The online ticket is valid only within the selected validity date specified by the customer at the time of purchase - a specific day, and its validity expires at the end of the validity period specified in paragraph 2.2. If the online ticket is not used within this specific period, without the customer changing the validity date or canceling the purchase contract according to Article 4 of these terms and conditions, the online ticket expires without entitlement to a refund of its purchase price.

2.11. The ticket is rendered invalid and tied to the holder upon the first passage through the turnstile, making it non-transferable! The ticket (ticket encoded on the chip card) is non-transferable, not the chip card itself as the ticket medium.

2.12. The purchased online ticket is activated after the first passage through the turnstile. Once the online ticket is activated, it is not possible to cancel the purchase contract.

2.13. The chip card serves as a travel pass only after the online ticket is activated according to section 2, paragraph 2.11 of these terms and conditions. Until this moment, the chip card does not entitle its holder to travel.

3. PRICE OF GOODS AND PAYMENT TERMS

3.1. The purchase price of online tickets purchased in the online store corresponds to the prices listed in the standard price list of the Mýto ski & bike center, which is available at all cash registers in the center and also on the website www.kopeczabavy.sk in the Price List and Opening Hours section.

3.2. The customer will always pay the price of the goods/services to the seller by non-cash payment through the Global Payments payment gateway, s.r.o., to which they are redirected after confirming the online ticket order. After the payment is made, the customer is informed about its successful or unsuccessful completion and redirected back to the online store page. If the payment is successful, the customer will receive a "Purchase Confirmation" email with a payment receipt and an electronic ticket with a QR code. The payment receipt also serves as an invoice, which the customer is required to keep for any complaints. If the payment is not successful, the customer will be informed about the error and redirected back to the last step in the online store. Any problems that occur during payment through the Global Payments payment gateway are the full responsibility of its operator, Global Payments, s.r.o., and the customer is obliged to resolve any payment complaints with Global Payments, s.r.o. If the customer does not receive an email with a QR code, they should immediately contact the technical support of online ticket purchases at tel. no. +421 911 379 378.

3.3. Purchases through the Global Payments payment gateway, s.r.o. can be made at any time, the system functions continuously except for technological breaks. Customers will be promptly informed by the operator about planned technological breaks of the system and the resulting inability to make payments within this time frame on their website.

4. WITHDRAWAL FROM THE PURCHASE AGREEMENT FOR THE PURCHASE OF AN ONLINE TICKET

4.1. A customer who purchases an online ticket in the online store more than 14 days before the start of ticket usage is entitled to withdraw from the purchase agreement and cancel the ticket within these 14 days without stating a reason.

4.2. When purchasing an online ticket in the online store less than 14 days before the start of ticket usage, the customer is entitled to withdraw from the purchase agreement and cancel the ticket, but this must be done at least one day before the start of ticket usage. In the event of a change in the start date of ticket usage, the customer's deadline for canceling the ticket is extended by a maximum of 14 days from the day of ticket purchase. A ticket with the same purchase date and validity start date cannot be canceled. The customer acknowledges and confirms that in the event of purchasing a ticket on the day of its usage, they lose the right to withdraw from the agreement.

4.3. Tickets that have not been used by the selected start date of ticket usage cannot be retrospectively canceled or have their validity extended, and the customer is not entitled to a refund of the purchase price for these tickets.

4.5. A ticket purchased through the online store can be canceled by email or in writing (in the case of submitting a written withdrawal from the agreement, it must be delivered to the operator no later than the day before the start of ticket usage). Provided that the provisions of paragraphs 4.1 and 4.2 of these terms and conditions are fulfilled, the customer will be refunded the cash to the bank account from which the tickets were purchased within 14 days from the cancellation request.

4.6. To cancel the ticket, please send a request by email to ski.myto@partizan.sk. Subsequently, the customer will be informed about the successful cancellation of the ticket and will receive an email "Cancellation Confirmation".

4.7. In the case of purchasing a season ticket and/or other tickets through the online store, the customer has the right to a refund:

- the full amount of money if the operator is not able to operate the transport facilities at all due to measures taken by the Central Crisis Staff of the Slovak Republic to prevent the spread of the SARS-CoV-2 coronavirus causing COVID-19

- a proportional amount if the operator is able to operate the transport facilities for less than 30 calendar days due to measures taken by the Central Crisis Staff of the Slovak Republic to prevent the spread of the SARS-CoV-2 coronavirus causing COVID-19 during the summer season 2021.

5. FILING AND PROCESSING OF COMPLAINTS, CLAIMS, AND SUGGESTIONS

5.1. The operator is responsible for defects that the ticket has at the time of its purchase by the customer, i.e. if it does not correspond to the data specified in the order. The customer is obliged to check the required data before confirming the order. 5.2. Based on a reasonable notice of defects in the ticket, the customer may assert claims arising from defects in the goods for which the operator is responsible. The contracting parties have agreed that the operator is obliged to rectify the defects in the ticket by delivering a ticket that corresponds to the data specified in the binding order or in the email confirming the change of the start date of the ticket's use in accordance with point 2.10. of these terms and conditions. If it is not possible to rectify the defect by delivering a ticket corresponding to the order, the customer is entitled to demand a discount from the purchase price or to withdraw from the contract.

5.3. The customer is entitled to send the operator suggestions or complaints about the provided services by email, and the operator will address them on an ongoing basis and respond to the sent suggestions or complaints by email within a maximum of 30 days.

6. PROVISION OF PERSONAL DATA

6.1. The customer is obliged to provide the operator with his personal data requested by the system, including the name, surname, permanent address, telephone number, email address or business name, registered office address, company identification number (IČO), tax identification number (DIČ), value-added tax identification number (IČ DPH), telephone number, and email address.

6.2. The customer acknowledges that the operator processes his personal data for the purpose of fulfilling the operator's obligation from the purchase contract concluded based on the ticket order and processing this data in the information system, which takes the form of the operator's electronic customer record.

6.3. The operator has a legitimate interest in sending messages to the customer regarding its activities in order to provide the customer with information about current discounts and promotions.

6.4. Provision of information in accordance with § 19 of Act No. 18/2018 Coll. in its valid version: a) operator: HOTELA PARTIZÁN, s.r.o., registered office at Bystrá 108, 977 01Bystrá,

b) purpose of processing personal data and legal basis:

- fulfilling the operator's obligation from the purchase contract concluded based on these terms and conditions and processing this data in the information system, which takes the form of the operator's electronic customer record,

- legitimate interest of the operator in informing the customer about current discounts and promotions,

c) the operator may provide personal data to persons providing accounting services, legal services, technical support, and entities authorized by specific regulations,

d) the operator does not intend to transfer personal data to a third country or international organization,

e) personal data will be stored for the duration of the contractual relationship and four years after its termination. With regard to data that the operator is required to retain for a longer period (for accounting purposes, fulfilling tax obligations, and for archiving purposes), the operator stores them for the period determined by a generally binding legal regulation. Personal data processed by the operator based on legitimate interest will be stored for a period of four (4) years from the date of contract conclusion or consent given. After this period, they will be destroyed.

g) upon a written request or in-person at the operator's premises, you have the right:

- to request access to your personal data and its rectification, erasure, or restriction of processing;

- to object to the processing of your personal data;

- to data portability;

- to revoke your consent for inclusion in the database of recipients of messages about current discounts and promotions at any time,

- to file a motion to initiate proceedings with the Office for Personal Data Protection of the Slovak Republic.

h) providing personal data is voluntary, but without providing them, it is not possible to conclude a contract, and in case of not providing the required data, the contract will not be concluded,

i) the obtained personal data are not subject to profiling or automated decision-making.

6.5. In the event that the customer has registered and created a username and password, he is obliged to keep them secure and not provide them to third parties. The operator shall not be liable for the consequences or damage caused by forgetting the data, providing them to a third party, or failing to secure their protection by the customer.

7. FINAL PROVISIONS

7.1. If any provision of these terms and conditions is invalid or ineffective, or becomes so, the provision closest to this invalid or ineffective provision shall be applied instead, in accordance with the relevant legal regulations. Other provisions of the invalidity or ineffectiveness of such a provision are not affected.

7.2. In matters not regulated by these terms and conditions, the rights and obligations of the parties shall be governed by the relevant provisions of Act No. 102/2014 Coll. on the protection of consumers in the sale of goods or provision of services under a distance contract or a contract concluded outside the seller's premises, as amended, and the Civil Code, as amended.

7.3. The operator is entitled to change or supplement the wording of these terms and conditions. However, this provision does not affect the rights and obligations arising during the effective period of the previous wording of the terms and conditions.

7.3. The customer has the right to exercise and resolve his/her rights and claims through alternative dispute resolution and for this purpose, submit a proposal to initiate alternative dispute resolution to the subject of alternative dispute resolution under Act No. 391/2015 Coll. on alternative dispute resolution of consumer disputes and on the amendment and supplementation of certain laws (hereinafter referred to as "ADR"). 7.4. The customer can also exercise his/her rights and claims through the European Online Dispute Resolution platform, which is available online at http://ec.europa.eu/consumers/odr/index en.htm.

7.5. By purchasing an online ticket, the customer accepts all provisions of these terms and conditions without reservation, and by checking the "I agree to the terms and conditions" box in the order form of the online ticket in the operator's online store, expresses explicit consent to these terms and conditions.

7.6. The wording of the terms and conditions that is available on the operator's website on the day of concluding the specific purchase agreement in the online store is considered valid and effective.
